MELING LO TAN A.K.A. "BE LING" Petitioner

ORDER

A verified petition dated August 11, 2011 has been filed by petitioner through undersigned counsel in the above-entitled case, alleging among other things, that petitioner's full name is Meling Lo Tan, 57 years old, married, Chinese citizen, of legal age and presently residing at c/o Monaco Oil Mill, Purok llang-ilang, Brgy. Silangang Mayao, Lucena City, she is married to Tan Ching Cheng a.k.a. Romeo Ng Tan, Filipino citizen, 65 years old, born on August 8, 1946 in Lucena City, Philippines; she has three (3) children, all of whom are of legal age, singles, Filipino citizens and all residing with the petitioner at c/o Monaco Oil Mill, Purok Ilang-ilang, Brgy. Silangang Mayao, Lucena City; petitioner has continuously resided in the Philippines for 57 years now as "Native Born Resident" having born to Sps. Antonio T. Lo a.k.a. Lo Kim Suy and Martina King at Daet Camarines Sur on March 31, 1954

and was issued a Native Born Certificate of Residence No. 241441 with alien Certificate of Residence No. B-149835 of the Commission on Immigration and Deportation (BID); Petitioner has all the qualifications required by Commonwealth Act 473, to wit, (a) She is 57 years old as of the filing of this petition, (b) She has resided in the Philippines for a continuous period of not less than 10 years (c) of good moral character and believes in the principles underlying the Philippine Constitution, and has conducted herself in a proper and irreproachable manner during the entire period of his residence in the Philippines in her relation with the constituted government as well as with the community in which she is living (d) Can fluently speak and write Tagalog, Bicol dialect and English, which are principal languages and widely used in the Philippines; and (e) Enrolled all her children in private schools recognized by the Department of Education, where Philippine history, government and civics are taught or prescribed as part of the school curriculum, during the entire period of the residence in the Philippines required of her prior to the hearing of her petition for naturalization as Philippine citizen; Petitioner does not possess any of the disqualifications for naturalization under the provisions of Commonwealth Act No. 473; She will reside continuously in the Philippines from the date of the filing of this petition up to the time of her admission to Philippine citizenship; She was born on March 31, 1954 in Daet, Camarines Norte, Philippines, where she grew up and where she also received her primary secondary education at Chung Hua High School, an educational institution recognized by the Government of the Republic of the Philippines not limited to any race of nationality, likewise Philippine history, government and civics are taught as part of the school curriculum where Meling Lo Tan graduated and finished elementary and high school under said

curriculum; She continued her studies at Far Eastern University (FEU), Manila City, Philippines, where she took up Bachelor of Science in Nursing, then she got married in 1988 to Ching Cheng Tan a.k.a. Romeo Ng Tan, at which time she moved to Lucena City up to the present; petitioner Meling enrolled all her three (3) children for primary and secondary education in Harmony Christian Education Foundation (HCEF) and Philippine Tongho Institute (PTHI), both private schools recognized by the Department of Education, where Philippine history, government, and civics are taught or prescribed as part of the school curriculum. The schools mentioned were not limited to any race or nationality; Petitioner Meling believes in the principles underlying the Philippine Constitution, is of good moral character and had conducted herself in a proper and irreproachable manner during the entire period of her residence in the Philippines in her relations with the constituted government as well as with the community in which she lives in. Copy of the Certificate of Good Moral Character issued by the Barangay Silangang Mayao, Lucena City; She has mingled socially with the Filipinos, and has evinced a genuine desire to learn and embrace the customs, traditions, and ideas of the Filipinos; Petitioner Meling is not opposed to organized government or affiliated with any association or group of persons who uphold and teach doctrines opposing all organized government; that she does not defend or teach the necessity or propriety of violence, personal assault, or assassination for the success and predominance of their ideas; that she is not a polygamist or a believer in polygamy or in the practice of polygamy; that she has never been convicted of any crime involving moral turpitude, that she is not suffering from mental alienation or incurable contagious disease; and that she is not a citizen or subject or a nation at war with the Philippines; She is exempted to comply with the requirements of Section 6 of the Revised Naturalization Law (C.A. No. 473) regarding the filing with the Office of the Solicitor General of her bonafide intention to become a citizen of the Philippines, being born in the Philippines;

Petitioner Meling received her primary and secondary education in a school recognized by the Government and not limited to any race or nationality, having resided continuously in the Philippines for a period of thirty years or more before filing their application. Likewise, petitioner Meling has provided and given primary and secondary education to all her children in private schools recognized by the Government and not limited to any race or nationality; That it is petitioner Meling's intention in good faith to become a citizen of the Philippines and to renounce absolutely and forever all allegiance and fidelity to any foreign state or sovereignty, if this petition is granted, and particularly to Republic of China (ROC) of which at this time she is citizen or subject and that she will reside continuously in the Philippine from the date of the filing of this petition up to the time of his admission to Philippine citizenship from any court.

Petitioner respectfully prays unto this Honorable Court that she be admitted as citizen of the Philippines.

Wherefore, finding the verified petition sufficient in form and substance, Let notice be given that said petition will be heard before this Court on June 26, 2012 at 8:30 o'clock in the morning.

Let the Notice of Petition for the Naturalization be published at the expense of the petitioner once a week for three (3) consecutive weeks in the Official Gazette and in a newspaper of general circulation in Quezon Province where the petitioner resides at least six (6) months before the hearing of the petition itself as above scheduled.

Let also a copy of the Notice of Petition notice be posted in public and conspicuous places in the office of the Clerk of Court of the RTC, Lucena City.

Furnish a copy of the Notice of petition for Naturalization as well as the petition to the Honorable Solicitor General.

Furnish a copy of this Order the Clerk of Court of RTC, Lucena City and the City Prosecutor's Office.

Furnish a copy of this Order the petitioner for his guidance and compliance.

PETITIONER

COMES NOW the Petitioner, and unto this Honorable Court most respectfully avers that:

1. Petitioner's full name is MELING LO TAN, 57 years old, married, Chinese citizen, of legal age and presently residing at c/o Monaco Oil Mill, Purok llang-ilang, Brgy. Silangang Mayao, Lucena City;

2. She is married to Tan Ching Cheng a.k.a. Romeo Ng Tan, Filipino citizen, 65 years old, born on August 8, 1946 in Lucena City, Philippines. She has three (3) children, all of whom are of legal age, singles, Filipino citizens and all residing with the petitioner at c/o Monaco Oil Mill, Purok Ilang-ilang, Brgy. Silangang Mayao, Lucena City; copies of their birth certificates are hereto attached as Annexes "A", "B" and "C;"

3. Petitioner has continuously resided in the Philippines for 57 years now as a "Native Born Resident" having born to Spouses Antonio T. Lo a.k.a. Lo Kim Suy and Martina King at Daet, Camarines Sur on March 31,

1954 and was issued a Native Born Certificate of Residence No. 241441 with Alien Certificate of Residence No. B-149835 of the Commission on Immigration and Deportation (now Bureau of Immigration and Deportation (BID}). Copy of the ICR/ACR is hereto attached as Annex “D”.

4. Petitioner has all the qualifications required by Commonwealth Act 473, to wit, (a.) She is 57 years old as of the filing of this petition. (b.) She have resided in the Philippines for a continuous period of not less than 10 years, (c.) Of good moral character and believes in the principles underlying the Philippine Constitution, and must have conducted himself in a proper

and irreproachable manner during the entire period of his residence in the Philippines in her relation with the constituted government as well as with the community in which she is living. (d.) Can fluently speak and write Tagalog, Bikol dialect and English, which are principal languages and widely used in the Philippines; and (e.) Enrolled all her children in private schools recognized by the Department of Education, where Philippine history, government and civics are taught or prescribed as part of the school curriculum, during the entire period of the residence in the Philippines required of her prior to the hearing of her petition for naturalization as Philippine citizen.

5. Petitioner does not possess any of the provisions of Commonwealth Act No. 473; disqualifications for naturalization under the

8. She continued her studies at Far Eastern University (FEU), Manila City, Philippines, where she took up Bachelor of Science in Nursing, then she got married in 1988 to Ching Cheng Tan a.k.a. Romeo Ng Tan, at which time she moved to Lucena City up to the present;

9. Petitioner Meling enrolled all her three (3) children for primary and secondary education in Harmony Christian Education Foundation (HCEF) and Philippine Tongho Institute (PTHI), both private schools recognized by the Department of Education,

where Philippine history, government, and civics are taught or prescribed as part of the school curriculum. The schools mentioned were not limited to any race or nationality. Copies of the Secondary Student's Transcript of Records are hereto attached as Annexes "G", "H” and “I”;

10. The names, gender, date and place of birth, the residence of each of her

children, the courses they took and the College or University where they graduated from or still enrolled in, are as follows, to wit:

Petitioner Meling believes in the principles underlying the Philippine Constitution, is of good moral character and had conducted herself in a proper and irreproachable manner during the entire period of her residence in the Philippines in her relations with the constituted government as well as with the community in which she lives in. Copy of the Certificate of Good Moral Character issued by the Barangay Silangang Mayao, Lucena City is hereto attached as Annex "L".

Female, born on September 3, 1989 at Manila City, Filipino citizen, took up B.S. in Nursing at Metropolitan Hospital School of Nursing, Manila City and graduated on March 10, 2010 as a Bachelor of Science in Nursing, now working at Air Philippines as Flight Stewardess.

MONICA LO TAN, 20 years old, Female, born on October 31, 1990 at Lucena City, Filipino citizen, took up Bachelor of Science in Accountancy at San Beda College, Mendiola, Manila City and graduated on March 2011 as a Bachelor of Science in Accountancy, and now reviewing for the Government Licensure Board Examination.

RAIZA LO TAN, 19 years old, Female, born on November 18, 1991 at Lucena City, Filipino citizen, taking up Bachelor of Science in Entrepreneur at University of Santo Tomas (UST), España Street, Manila City;

Petitioner Meling has continuously resided in the Philippines since her birth in 1954, and for at least 23 years at Lucena City, immediately preceding the filing of this petition; copy of the Certification of Residency issued by the Office of the Punong Barangay of Silangang Mayao, Lucena City is hereto attached as Annex "J".

12. Her husband, Ching Cheng Tan is the registered owner of real estate covered by TCT No. T-88689, situated in Barrio of Silangang Mayao, Lucena City, which property is worth, not less than Five Thousand (Php5,000.00) Pesos, Philippine Currency; copy of Transfer Certificate of Title is hereto attached as Annexes "K" and said property is declared for taxation purposes in the name of the Tan Ching Cheng;

to learn and embrace the customs, traditions, and ideas of the Filipinos;
