AN ACT to amend and re-enact Section 1134, Wyoming Compiled Statutes, 1920, relating to the distribution of the official reports of decisions of the Supreme Court. Be It Enacted by the Legislature of the State of Wyoming: Section 1. That Section 1134, Wyoming Compiled Statutes, 1920, be amended and re-enacted to read as follows: Section 1134. The books delivered to the Librarian shall be used by him for the purpose of distribution as follows: One copy of each volume shall be delivered to each justice of the Supreme Court, and to each district Judge there shall be delivered as many copies as he has counties in his district, and to each State Officer, said books to be labeled as the property of the State, and to be retained in the offices of said officials and by them delivered to their respective successors in office; one copy shall be furnished to the library of the Supreme Court of the United States at Washington, one copy to the office of the Attorney General of the United States, and one copy to the office of the United States District Judge for the District of Wyoming. The remaining copies shall be used in exchange for the reports of other states and territories and governments as shall be determined upon by the justices of the Supreme Court, and a reasonable number shall be kept in the State law library. AN ACT to amend and re-enact Section 1450, Wyoming Compiled Statutes, 1920, relating to nomination and election of county and Prosecuting Attorneys. Be It Enacted by the Legislature of the State of Wyoming: Section 1. That Section 1450, Wyoming Compiled Statutes, 1920, be amended and re-enacted to read as follows: Section 1450. There shall be in each organized county, a county and prosecuting attorney who shall at the time of his nomination and election as said county and prosecuting attorney, and during his term of said office, be a member of the bar of this state, and who shall, before entering upon the duties of his office, take the oath required of other county officers and give bond to the people of this State in the penal sum of two thousand dollars, with sufficient surety, to be approved by the board of county commissioners, conditioned for the faithful performance of the duties of his office, as required by law, and said bond shall be filed with the county clerk, and a copy of his certificate of election and oath shall be filed by such attorney with the clerk of the district court sitting for his county. QUALIFICATIONS OF COUNTY SUPERINTENDENT OF SCHOOLS. AN ACT to amend and re-enact Section 1548, Wyoming Compiled Statutes, 1920, relating to qualifications for nomination and election of county superintendent of Public Schools. Be It Enacted by the Legislature of the State of Wyoming: Section 1. That Section 1548, Wyoming Compiled Statutes, 1920, be amended and re-enacted to read as follows: Section 1548. There shall be in each organized county a superintendent of public schools, who shall, at the time of his nomination and election as said superintendent possess a Wyoming teachers certificate of as high a rank as first class in full force and effect: and who shall before entering upon the duties of his office, take the oath prescribed by the constitution and give bond to the State of Wyoming in the penal sum of five hundred dollars for the faithful performance of all duties required by him by law as such superintendent, to be approved by the board of county commissioners, and together with his certificate of election and oath, filed in the county clerk's office; provided, that no person shall at the same time hold the positions of county superintendent of public schools and teacher in any public school in his or her county. Section 2. This Act shall take effect and be in force from and after its passage. Approved February 12, 1925. CHAPTER 35. Original House Bill No. 44. QUALIFICATIONS OF ELECTORS IN SCHOOL ELECTIONS. AN ACT to amend and re-enact Section 2244, Wyoming Compiled Statutes, 1920, relating to the qualifications of electors for voting on special school tax appropriations or the bonding of school districts. Be It Enacted by the Legislature of the State of Wyoming: Section 1. That Section 2244, Wyoming Compiled Statutes, 1920, be amended and re-enacted to read as follows: Section 2244. All school district elections shall be carried on as provided by law, and the qualifications of voters at such elections shall be the same as at any other election, and in addition thereto, such voter shall be in possession of a tax receipt, from the tax collector of the county in which such election is being held, showing that such voter is a taxpayer on real property in such school district; or shall make an affidavit upon oath before the school trustees before whom he or she offers to vote, that he or she is the owner, or is the husband or the wife of the owner of real property in such school district; provided, however, that the tax qualification mentioned in this section shall apply only to questions of special school tax appropriations of money and bonding such school district. Section 2. All Acts or parts of Acts in conflict herewith are hereby repealed. Section 3. This Act shall take effect and be in force from and after its passage and approval. AN ACT to amend and re-enact Section 1, Chapter 102, Session Laws of Wyoming, 1923, defining the qualifications of electors in Bond Elections. Be It Enacted by the Legislature of the State of Wyoming: Section 1. That Section 1, Chapter 102, Session Laws of Wyoming, 1923, be amended and re-enacted to read as follows: Section 1. No elector shall be eligible to vote for or against any bonds in any regular or special election unless he or she shall produce a tax receipt showing that he or she is a tax payer on real property, or shall make an affidavit upon oath before the election board before which he or she offers to vote, that he or she is the owner, or is the husband or the wife of the owner of real estate in the district, town, county, or state proposing to issue such bond. Section 2. All Acts or parts of acts in conflict herewith are hereby repealed. Section 3. This Act shall take effect and be in force from and after its passage and approval. Approved Februbary 14, 1925. CHAPTER 37. Original House Bill No. 18. SALARIES OF OFFICERS IN CITIES OF FIRST CLASS. AN ACT to amend and re-enact Section 1797, Wyoming Compiled Statutes, 1920, relating to Salaries of Officers in Cities of the First Class. Be It Enacted by the Legislature of the State of Wyoming: Section 1. That Section 1797, Wyoming Compiled Statutes, 1920, be and the same is hereby amended and re-enacted to read as follows: Section 1797. The salaries of all officers shall be fixed by ordinance and shall be not exceeding the following sums per annum respectively: attendance at each regular or special meeting of the City $1200.00 per annum The foregoing to be construed as limitations and not fixed salaries. All other officers of the City shall receive such compensation as the Mayor and City Council shall fix by ordinance. Section 2. "Whoever shall receive any more than the sums of money above prescribed for his respective office shall be punishable by a fine not less than One Hundred Dollars and not to exceed One Thousand Dollars." Be It Enacted by the Legislature of the State of Wyoming: Section 1. That Section 3459, Wyoming Compiled Statutes, 1920, be amended and re-enacted to read as follows: Section 3459. The provisions of this chapter shall not apply to sales made to dealers by commercial travelers selling in the usual course of business, or to sheriffs, constables, bona fide assignees, receivers or trustees in bankruptcy, or other public officers selling goods, wares and merchandise according to law, nor to any person selling fruits, vegetables, dressed meats, fowls or farm products, by a bona fide resident of the State. Section 2. All Acts or parts of Acts in conflict herewith are hereby repealed. Section 3. This Act shall take effect and be in force from and after its passage. Approved February 17, 1925. CHAPTER 39. Original House Bill No. 2. PRESIDENTIAL ELECTIONS. AN ACT to amend and re-enact Sections 256, 2594 and 2599, Wyoming Compiled Statutes, 1920, relating to election of presidential electors, providing for the printing of the names of Presidential and Vice-Presidential candidates on the ballots and squares after each name on official ballot and order of arrangement of names. Be It Enacted by the Legislature of the State of Wyoming: Section 1. That Section 256, Wyoming Compiled Statutes, 1920, be amended and re-enacted to read as follows: Names of Candidates for Presidential Electors and Candidates for President and Vice President on Ballot. Section 256. At the general election next preceding the choice of President and Vice President of the United States of America, there shall be elected as many electors for President and Vice President of the United States of America as this State may be entitled to elect of Senators and Representatives in Congress. The names of presidential electors shall appear on the ballot and in addition thereto shall appear the names of presidential and vice presidential candidates in their respective party designated columns. The number of votes received by presidential and vice presidential candidates shall, within the meaning of this Act, be the number of votes to be credited to each of the electors representing them. Section 2. That Section 2594, Wyoming Compiled Statutes, 1920, be amended and re-enacted to read as follows: Position of Square After Names of Candidates for Presidential Electors. Section 2594. After and to the right of the name of each candidate for an office and within each party designated column and separated from the lines dividing the columns shall be a square clearly designated by heavy black lines in which the voter may designate by a cross his choice for each office, except that in each party's designated column, opposite the names of presidential and vice-presidential candidates and their presidential electors, if any, there shall be but one square for all.
