And if four-fifths of the tax so received in the fund for the "state seminary" money shall not be sufficient to satisfy all of said appropriations, then the deficiency of the same shall be chargeable to the moneys received in the fund known as the "educational fund" to an amount not exceeding four-fifths thereof, derived from the tax collected and received in said last mentioned fund from collateral inheritance, legacies, gifts and conveyances, under article 14 of chapter 2 of the Revised Statutes of Missouri, 1909, to the extent of four-fifths of the amount so received. The disbursements of the various sums appropriated shall be made in such order as the board of curators shall determine.

All moneys appropriated in the preceding sections shall be used for the purposes enumerated and any liability or debt incurred in excess thereof shall be chargeable to the person or persons authorizing or incurring the same.

Sec. 9a. From seminary fund-deficiency. For the purpose of meeting the deficiencies of 1913 and 1914, caused by the over-appropriation of the moneys derived from the "seminary fund" by the 47th general assembly:-There is hereby appropriated the further sum as follows: For completion of library building, thirty thousand eight hundred seventy-three dollars and thirteen cents ($30,873.13), payable out of the moneys appropriated belonging to the seminary fund, and if four-fifths of the tax so received in the fund for the state "seminary moneys" shall not be sufficient to satisfy all of said appropriations, then the deficiency of the same shall be chargeable to the moneys received in the fund known as the "educational fund," to an amount not exceeding fourfifths thereof, derived from the tax collected and received in said

last mentioned fund from collateral inheritance, legacies, gifts and conveyances, under said article 14 of chapter 2 of the Revised Statutes of Missouri, 1909, to the extent of four-fifths of the amounts so received. The disbursements of the various sums appropriated in these sections shall be made in such order as the board of curators shall determine. All moneys appropriated in the preceding sections shall be used for the purposes enumerated; and any liability or debt incurred in excess of the amount herein appropriated shall be chargeable to the person or persons authorizing or incurring the same.

Sec. 10. School of mines. For the support and maintenance of the school of mines, and metallurgy, at Rolla, the sum of forty thousand dollars ($40,000.00), as follows:

Sec. 11: School of mines from seminary moneys.-There is hereby appropriated out of any money in the state treasury belonging to the "state seminary moneys," and out of one-fifth of the money received therein from the tax collected on collateral inheritance, legacies, gifts and conveyances under article 14 of chapter 2, of the Revised Statutes of Missouri, 1909, not otherwise appropriated, for the support, extension, improvement and other special needs, and for the erection and equipment of buildings for the school of mines and metallurgy, at Rolla, the sum of one hundred forty-two thousand and four hundred dollars ($142,400.00), as follows:

Construction for sidewalks, on Pine, 14th and 15th streets, and Vichy road in compliance with an order from the city of Rolla.....

And, if one-fifth of the tax so collected in the fund of the "state seminary moneys" shall not be sufficient to satisfy all of said appropriations, then the deficiency of the same shall be chargeable to the moneys required [received] in the fund known as the "edu

cational funds," to an amount not to exceed one-fifth thereof, derived from the tax collected and received in said last mentioned fund from collateral inheritance, legacies, gifts and conveyances, under said article 14 of chapter 2 of the Revised Statutes of Missouri, 1909, to the extent of one-fifth of the amount so received. The disbursement of the various sum[s] appropriated in this section. shall be made in such order as the board of curators shall determine. All moneys appropriated in the preceding sections shall be used for the purposes enumerated; and any liability or debt incurred in excess thereof shall be chargeable to the person or persons authorizing or incurring the same.

Sec. 11a. School of mines from seminary moneys-reappropriation. There is hereby appropriated out of any money in the state treasury, belonging to the state seminary moneys and out of one-fifth of the money received therein from tax collected on collateral inheritance, legacies, gifts and conveyances under article 14, chapter 2 of the Revised Statutes of Missouri, 1909, not otherwise appropriated, for the improvement and special needs and for the erection and completion of buildings for school of mines and metallurgy, at Rolla, the sum of twenty-three thousand six hundred forty-three dollars and eighty-five cents ($23,643.85), as follows: For fireproof gymnasium building, fourteen thousand and nine dollars and one cent ($14,009.01); for plumbing, wiring and steam fitting gymnasium building, one thousand nine hundred forty dollars and twenty cents ($1,940.20); for steam, water and sewer lines to gymnasium building, two thousand seven hundred fifty-seven dollars four cents ($2,757.04); for lockers and equipment and furniture for gymnasium building, four thousand nine hundred thirty-seven dollars and sixty cents ($4,937.60). The same being a reappropriation of the amounts remaining unpaid of the appropriation of 1913 and 1914, for the completion and equipment of the gymnasium building.

Sec. 12. Salaries, support and new buildings, when and how paid. The amounts herein appropriated for salaries and support of the educational institutions of the state shall be payable only out of the state treasury on the first day of every month in each year, and then only upon requisition drawn and authorized by the board of regents or president of such institution, accompanied by the original vouchers properly approved by said above named board or president, to be filed by the state auditor with such requisition or requisitions as record in the office of state auditor, and it shall be made the duty of the state auditor when such requisitions and accounts are filed to issue warrants on the state treasurer in favor of the treasurer of said institutions for the amount of said. claims due and payable. No warrants shall be issued by the state auditor until he has audited claims so filed. Every requisition filed with the state auditor shall be accompanied with a detailed statement of the moneys received and disbursed during the previous month, and all outstanding accounts and the amount of money on hand which statement shall be verified by oath of the

president or secretary of such institutions. No money herein appropriated shall be dispersed [disbursed] until the aforegoing conditions are complied with; and not more than one-half of any money herein appropriated for the erection of new buildings at any of said institutions shall be payable before December first, 1915, provided they shall not apply to re-appropriations of money for completion of buildings.

Sec. 13. Emergency. The fact that no funds are available to meet the present obligations and necessary expenses of the institutions herein mentioned, creates an emergency within the meaning of the Constitution; therefore, this act shall be in force and effect from and after its passage.

AN ACT to appropriate money for the support, maintenance and improvement of the eleemosynary and penal institutions of the state for the years 1915 and 1916, and to pay deficiencies of said institutions for the years 1913 and 1914, with an emergency clause. SECTION

Be it enacted by the General Assembly of the State of Missouri, as follows: Section 1. Purpose of act.-There is hereby appropriated out of the state treasury, chargeable to the state revenue fund, for the support, maintenance, repairs and improvement of the eleemosy

nary and penal institutions of this state, for the payment of salaries of the officers and employes of said institutions during the years 1915 and 1916, and to pay the deficiencies of said institutions for the years 1913 and 1914, the following sums:

Sec. 2. For support state hospital No. 1, Fulton.-There is hereby appropriated out of the state treasury, chargeable to state hospital number 1 fund, of the money arising from the payment into the state treasury by the treasurer or other financial officer of said institution in pursuance of the requirement of section 2 of "An act establishing special funds for the penal and eleemosynary institutions of the state, providing for the payment of certain moneys therein, and for other purposes," approved March 9, 1893, for the support and maintenance of said institutions for the years 1915 and 1916, the sum of five hundred thousand dollars ($500,000.00), or as much thereof as may be necessary.

Sec. 3. State hospital No. 1, Fulton. For the "state hospital No. 1" at Fulton, the sum of one hundred and six thousand and four hundred ninety dollars ($106,490.00), as follows:
