CHAPTER 53

An Act to amend The Horse Breeders Act.

[Assented to February 3, 1922.]

IS Majesty, by and with the advice and consent. of the Legislative Assembly of Saskatchewan, enacts as follows:

Subsection (3) of section 10 of The Horse Breeders Rev. Stat. Act is repealed and the following substituted therefor:" "(3) Members shall be paid their hotel and travelling expenses while attending meetings of the board. Members other than those whose whole time is at the disposal of the Government or of the University of Saskatchewan shall receive, in addition, an allowance of $7 for each day or part of a day spent in attending meetings of the board. Such payments and allowances shall be chargeable to and payable out of the consolidated fund."

CHAPTER 54

An Act to amend The Stray Animals Act.

[Assented to February 9, 1922.]

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1. The Stray Animals Act is amended in the manner hereinafter set forth.

2. The following is inserted after section 10:

"10a. The council of a municipality may make bylaws for licensing and controlling herders and determining the conditions under which they shall be permitted to herd animals within the municipality, provided such bylaws do not conflict with any bylaw passed under section 4 and are otherwise in accordance with the provisions of this Act."

3. Subsection (1) of section 27 is repealed and the following substituted therefor:

“27.—(1) In case such owner is not known the poundkeeper shall at once forward to the King's Printer for insertion in The Saskatchewan Gazette a notice in the form prescribed in subsection (1) of section 26, along with a fee of $2 for each animal impounded:

"Provided that the fees payable to the King's Printer in connection with each impoundment shall not exceed $5."

4. Section 28 is amended by inserting the words "use reasonable diligence to" after the word "shall" in the third line.

5. The following section is inserted immediately before section 29:

"28a.-(1) In case the owner of an impounded animal shall not, within ten days after the mailing or three days after delivery of the notice mentioned in section 26, cause the release of such animal by payment of the lawful fees, mileage rates and claim for damages, the pound

keeper shall at once post notices of sale in three conspicuous places within the herd district or rural municipality, as the case may be, one of which shall be the post office nearest to the pound, and, after such notices have been posted for eight days, he shall sell the impounded animal by public auction in accordance with the provisions of section 29a.

"(2) The poundkeeper on the date of posting notices of sale shall send a copy of the notice by registered letter to the owner of the impounded animal and shall also at the same time cause a notice of the sale to be published in a newspaper circulating in the district."

6. (1) The expression "(1)" at the beginning of Section 29 section 29 is deleted.

(2) Subsection (2) of the said section 29 is repealed and the following section substituted therefor:

"29a. The poundkeeper shall be the auctioneer at Auctioneer all sales of impounded animals, which shall be held at place of sale the pound, and shall commence at the hour of two

o'clock in the afternoon."

(3) Subsection (3) of the said section 29 is renumbered "296."

7.—(1) Paragraphs 1 and 2 of subsection (1) of section Section 39 39 are amended by striking out the words "capturing and" in the first lines thereof.

(2) Paragraph 5 of the said subsection is amended by substituting the words "into pound" for "and impounding" in the first line.

8. (1) Subsection (1) of section 42 is repealed and Section 42 the following substituted therefor:

"(1) A person who has on his premises or in his band, herd or flock an estray, which cannot be driven away, the owner being unknown to him, shall at once forward to the secretary treasurer of the municipality to be filed by him and to the King's Printer a notice to the effect that such animal is on his premises, or in his band, herd or flock, as the case may be, which notice shall contain the name, place of abode and post office address of the finder and a full description of the animal with all its marks (natural and artificial), colour and probable age, and any information which may lead to its identification."

(2) Subsection (2) of the said section is amended by striking out the first five words and substituting therefor the words "The King's Printer shall publish such notice."

(3) Subsection (4) of the said section is renumbered as section "42a."

9. The following section is inserted after section 44:

'44a.-(1) In case the owner shall not remove his animal within the period mentioned in section 41, the finder shall:

"(a) cause notices of sale to be posted for eight days in three conspicuous places in the vicinity of the finder's residence, one of which shall be the nearest post office;

"(b) on the day on which such notices are posted, send a copy of the notice by registered letter to the owner of the animal;

"(c) cause a notice of the sale to be published in the nearest newspaper; and

"(d) make application for sale to a justice.

"(2) Such justice may, if satisfied that the provisions of section 41 and of subsection (1) of this section have been complied with, proceed to sell the animal, in which case the provisions of subsections (4) and (5) of section 45 shall apply."

10. (1) Subsection (4) of section 45 is amended by striking out the words "by him" in the first line and substituting "for the sale."

(2) Subsection (6) of the said section is renumbered as section "45a.”

CHAPTER 55

An Act to amend The Saskatchewan Farm Loans Act.

[Assented to February 3, 1922.]

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts

as follows:

1. The Saskatchewan Farm Loans Act is amended in Rev. Stat. the manner hereinafter set forth.

2.-(1) Section 25 is amended by inserting at the Section 25 beginning of the first line the words "Subject to the provisions of subsection (2).”

(2) The said section 25 is further amended by adding thereto the following subsection:

"(2) Where the title to land is held by the board, the Provincial Treasurer may advance to the board such sums as it deems necessary to provide for maintaining the property in good condition, and for payment of taxes due or accruing due thereon and premiums of insurance against loss by fire, by hail or by cyclone, wind storm or tornado. As security for repayment of such advance the board shall deposit with the Provincial Treasurer the duplicate certificate of title to the land in respect of which the advance is made."
