CHAPTER 6

An Act to amend Chapter 94 of the Statutes of

1918-19.

[Assented to January 24, 1922.]

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1. Form A in the schedule to chapter 94 of the statutes Schedule Form of 1918-19, An Act to validate and confirm a Certain Agreement between His Majesty the King, in right of the Province of Saskatchewan acting and represented by the Provincial Treasurer, of the first part, and The Saskatchewan Co-operative Creameries, Limited, of the second part, is amended by striking out the certificate at the end thereof and substituting therefor the following:

"I hereby certify that I have made a personal inspection of the buildings proposed to be purchased and have personally inquired into the facts herein before set out, estimated and that the cost of said buildings (including actual new equipment and remodelling) amounts to

2. Form B in the schedule to the said Act is amended by striking out the certificate at the end thereof and substituting therefor the following:

"I hereby certify that I have made a personal inspection of the site and have examined the specifications of all buildings proposed to be constructed, and have personally inquired into the facts herein before set out and that the estimated cost of said site and buildings. amounts to

3. Form C in the schedule to the said Act is amended by striking out the certificate at the end thereof and substituting therefor the following:

CHAPTER 7

An Act to amend The Municipalities Relief Act.

[Assented to February 3, 1922.]

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts

as follows:

1. The Municipalities Relief Act, 1920, is amended in 1919-20, c. 33 the manner hereinafter set forth.

2. The following sections are inserted after section 3: New sections "3a. An order of the Lieutenant Governor in Council Order in No. 52 of 1921 and dated January 7, 1921, ratifying firmed and confirming a memorandum of agreement between the Honourable James Lougheed, Minister of the Department of the Interior, on behalf of the Government of the Dominion of Canada, and the Honourable W. M. Martin, Premier, on behalf of the Government of the Province of Saskatchewan, entered into on the sixteenth day of December, 1920, which order in council and agreement are set out in the schedule to this Act, is approved, ratified and confirmed and the said agreement is declared to be and always to have been from the date of the execution thereof valid and binding upon the parties thereto.

"3b. An order of the Lieutenant Governor in Council Order in No. 2015 of 1921 and dated November 9, 1921, ratifying firmed and confirming a memorandum of agreement between the Honourable James Lougheed, Minister of the Department of the Interior, on behalf of the Government of the Dominion of Canada, and the Honourable W. M. Martin, Premier, on behalf of the Government of the Province of Saskatchewan, entered into on the twenty-seventh day of October, 1921, which order in council and agreement are set out in the schedule to this Act, is approved, ratified and confirmed and the said agreement is declared to be and always to have been from the date of the execution thereof valid and binding upon the parties thereto."

3. Section 4 is repealed and the following substituted New section 4 therefor:

"4. Any and all orders in council heretofore made for the purpose of performing the terms of any of the said agreements on behalf of the Government of Saskatchewan are hereby approved, ratified and confirmed."

4.-(1) Section 5, as amended by section 1 of chapter 11 of the statutes of 1920, is further amended by inserting therein the following as subsection (3):

"(3) Notwithstanding anything contained in subsection (1), any municipality may borrow from a bank such sum as shall appear to the council to be required to make advances of coal and flour up to the first day of June, 1922, to farmers who, owing to failure of crops in the season of 1921 are unable to procure the same for themselves, and may repay such sum as set forth in subsection (1)."

(2) Subsection (3) of the said section 5 is renumbered (4).

5. (1) Subsection (1) of section 7 is amended by striking out the words "one year" in the sixth line and substituting "two years."

(2) Section 7, as amended by section 2 of chapter 11 of the statutes of 1920, is further amended by adding thereto the following as subsection (3):

"(3) Notwithstanding the provisions of subsection (1) promissory notes given by a municipality for moneys borrowed under subsection (3) of section 5 shall be made. payable on a date not later than the first day of January, 1923, and may from time to time be renewed for a further period not exceeding in all one year from the said first day of January, 1923."

6. Section 21, as amended by section 3 of chapter 11 of the statutes of 1920, is further amended by adding thereto the following subsection:

"(4) Any amounts remaining unpaid after the thirtyfirst day of December, 1922, on notes given for advances of coal and flour made after the date when this subsection comes into force may be recovered in the same manner as taxes may be recovered under The Rural Municipality Act."

7. The following is inserted after section 24:

"24a. Where the Lieutenant Governor in Council has given the guarantee mentioned in section 23 and the Provincial Treasurer has subsequently paid off the guaranteed debt, the council shall continue to make the levy required by section 22 until the province has been

repaid the full amount advanced under the guarantee; and the council shall, until such repayment, pay interest to the Provincial Treasurer, at such times and at such rates as he may require, upon the unpaid balances from time to time owing to the province; and shall also pay to the Provincial Treasurer such principal sums as may be from time to time collected."

8. This Act shall apply retrospectively as of and from Retrospective the first day of October, 1921, and all orders heretofore made and approvals given by the minister for the purpose of carrying out its objects are hereby ratified and confirmed and declared to be and always to have been legal and valid

9. The schedule is amended by adding thereto as parts Schedule II and III the following:

The Executive Council, having had under consideration a Memorandum of Agreement between the Honourable James Lougheed, Minister of the Department of the Interior, on behalf of the Government of the Dominion of Canada, and the Honourable W. M. Martin, Premier, on behalf of the Government of the Province of Saskatchewan, entered into on the sixteenth day of December, 1920, a copy of which Memorandum of Agreement is attached hereto and made part of this Minute, advises that the said Agreement be hereby ratified and confirmed, and declared to be and always to have been from the date of the execution thereof valid and binding upon the parties thereto.

MEMORANDUM OF AGREEMENT.

Memorandum of Agreement between the Honourable James Lougheed, Minister of the Department of the Interior, on behalf of the Government of the Dominion of Canada, and the Honourable W. M. Martin, Premier, on behalf of the Government of the Province of Saskatchewan, entered into this 16th day of December, 1920.
