CHAPTER 77

An Act to amend The Partnership Act.

[Assented to February 3, 1922.]

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1. Subsection (1) of section 35 of The Partnership Act is repealed and the following substituted therefor:

"(1) Subject to any agreement between the partners every partnership is dissolved as regards all the partners by the death or bankruptcy of any partner, or by his making an authorised assignment under The Bankruptcy Act."

CHAPTER 78

An Act to amend The Bulk Sales Act.

[Assented to February 3, 1922.]

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1. The Bulk Sales Act is amended by adding thereto Rev. Stat. the following sections:

"33. Where a vendor is a tenant having goods or Right of landchattels on which the landlord has distrained or would train or be entitled to distrain for rent, the right of the landlord to distrain or realise his rent by distress shall cease from and after the date of the payment, delivery or transfer to the trust company, but in the distribution of the property the company shall pay to the landlord in priority to all other debts an amount not exceeding the value of the distrainable assets and not exceeding three months' rent accrued due prior to the date of such payment, delivery or transfer, and the costs of distress, if any.

"34. The landlord may prove as a general creditor May prove for:

"(a) all surplus rent accrued due on the date of the
payment, delivery or transfer; and

"(b) any accelerated rent to which he may be entitled
under his lease, not exceeding an amount equal

Section 20 amended

CHAPTER 79

An Act to amend The Chattel Mortgage Act.

[Assented to February 3, 1922.]

IS Majesty, by and with the advice and consent of

1. Section 2 of The Chattel Mortgage Act is repealed and the following substituted therefor:

"2. In the application of this Act, the word 'creditors' where it occurs, shall extend to creditors of the mortgagor or bargainor suing on behalf of themselves and other creditors and to a trustee in bankruptcy as well as to creditors having executions against the goods and chattels of the mortgagor or bargainor in the hands of the sheriff."

2. Subsection (8) of section 20 of the said Act is repealed and the following substituted therefor:

"(8) Nothing in subsections (6) and (7) contained shall derogate from the priority above conferred upon seed grain mortgages or from the priority given to seed grain advances under any Act respecting advances to purchase seed grain, or from the priority given to a thresher's lien under The Threshers' Lien Act, or the priority given to a landlord under The Landlord and Tenant Act, but, subject to such priorities, a mortgage or incumbrance taken under subsection (6) shall not be affected by any incumbrance whenever created or by any writ of execution against the mortgagor in the hands of the sheriff at the time of its registration, but such mortgage or incumbrance shall create a preferential lien next in priority after seed grain mortgages, advances, threshers' liens, and any prior right given a landlord, as above mentioned."

An Act to amend The Conditional Sales Act.

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1. Section 9 of The Conditional Sales Act is amended Rev. Stat. c. 201, s. 9, by striking out the words "Nothing in this Act" at the amended beginning of the first line and substituting therefor the words "Nothing in sections 3 and 4 of this Act."

CHAPTER 81

An Act to amend The Threshers' Lien Act.

[Assented to February 9, 1922.]

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1. Section 2 of The Threshers' Lien Act is amended by striking out the words "and who has complied with the provisions of The Noxious Weeds Act regarding threshing machines" occurring in the third, fourth, and fifth lines.
