CHAPTER 95

An Act to authorise the Council of St. Chad's
College of the Diocese of Qu'Appelle to confer
Degrees in Divinity.

[Assented to February 3, 1922.]

HEREAS the Synod of the Diocese of Qu'Appelle was

incorporated by an Act of the Parliament of Canada, being chapter 33 of the statutes of 1885, with power inter alia to provide for schools and colleges; and

Whereas, the said Synod of the Diocese of Qu'Appelle has established and is conducting, at the City of Regina, a college known as St. Chad's College, for the purpose of training students for the ministry of the Church of England in Canada; and

Whereas, the said college is affiliated with the University. of Saskatchewan, and the studies, lectures, examinations and exercises are directed according to a Constitution of the Council of St. Chad's College, adopted by the said Synod, which yearly elects members to that Council; and

Whereas, the General Synod of the Church of England in Canada has by Canon adopted a schedule of studies for the degrees of Licentiate of Theology (L.Th.), Bachelor of Divinity (B.D.), and Doctor of Divinity (D.D.), to apply to all theological colleges of the Anglican Church, in the Dominion of Canada, in which is included St. Chad's College; and

Whereas, a petition has been presented by the Synod of the Diocese of Qu'Appelle praying for power to confer degrees in Divinity, and it is expedient to grant the prayer of the said petitioner:

Therefore, His Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1.

CHAPTER 96

An Act to amend An Act to incorporate
Sacred Heart Academy

[Assented to February 9, 1922.]

HEREAS a petition has been presented praying for the amendment of An Act to incorporate Sacred Heart Academy, being chapter 80 of the statutes of 1920, to provide for the exemption from taxation except for local improvements of the property of the petitioners real and personal, in Regina, Saskatchewan; and

Whereas, it is expedient to grant the prayer of the said petition:

Therefore His Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1. Section 6 of An Act to incorporate Sacred Heart Academy, being chapter 80 of the statutes of 1920, is amended by changing the figures "1921" in the proviso to "1922."

CHAPTER 97

An Act to incorporate the Luther Academy.

HEREAS the Reverend Leo. F. Tank, Reverend J. Preamble Fritz, Reverend E. G. Hertz, J. D. Miller and John Pfeifer have, by their petition, represented that they are the trustees of Luther Academy, situate at Melville, in the Province of Saskatchewan, maintained and conducted as an educational institution under the authority of the Evangelical Lutheran Joint Synod of Ohio and other States; and

Whereas, it will tend to advance and extend the usefulness of the said academy and promote the purposes for which it has been established if it be incorporated:

Therefore His Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1. The Reverend Leo F. Tank, Reverend J. Fritz, Incorporation Reverend E. G. Hertz, J. D. Miller and John Pfeifer and such others as may from time to time be appointed, as hereinafter provided, shall be and are hereby constituted a body corporate and politic under the name of "Luther Academy" for the purposes of education and knowledge.

2. The corporation may from time to time and at all Acquisition times hereafter purchase, lease, acquire, hold, possess and actual use and enjoy and may have, take and receive for them and their successors lands, tenements and hereditaments and real and immoveable property and estate within Saskatchewan necessary for actual use and occupation as academy buildings and offices, residences of professors, tutors, students and officers with garden, pleasure ground, athletic grounds and other ground used for academy purposes pertaining thereto and the same may sell, let on lease or on hire, alienate and dispose of and others in their stead purchase, lease, acquire and hold for the uses and purposes aforesaid.

3. The said corporation in its corporate name shall Acquisition have power and authority to take, accept or receive to the use and for the purposes of the said corporation, any and all lands, tenements, hereditaments and any

and all property, moveable or immoveable, stocks, shares, lands, debentures, money or securities for the payment of money by purchase, gift, devise, bequest or otherwise howsoever and shall have and hold the same and every of them and every part thereof to and for the use and purposes of the said corporation:

Provided, however, that the said corporation shall not acquire or hold as purchasers any land except for the actual use and occupation of the corporation or a branch thereof, or for the purposes of the corporation, and that any land, tenements or hereditaments acquired by gift, devise or bequest and not required for the actual use and occupation of the corporation or a branch thereof or for the purposes of the corporation the annual value of which together with the other lands of the corporation exceeds ten thousand dollars ($10,000) shall not be held by the corporation for a longer period than seven years and within such period the same shall be absolutely disposed of by the corporation, and in case of failure to dispose of the same within such seven years, or within any further period to which the term shall be extended by order of the Lieutenant Governor in Council, such land shall be forfeited to the Crown in the right of the province.

4. It shall be lawful for the said corporation and it is hereby empowered to draw, accept and make and to indorse, discount and negotiate bills of exchange and promissory notes and other negotiable instruments, to borrow or raise money by the issue of bonds, mortgages or any other securities founded or based upon all or any of the property and rights of the corporation or without any such security and upon such terms as to priority or otherwise as the corporation shall think fit, to sell, let on lease or on hire, exchange, mortgage, hypothecate or otherwise dispose of or pledge any lands, tenements or hereditaments or other real and personal property, stocks, shares, lands, debentures or securities of which it may at the time of the passing of this Act or at any future time be or become seized, possessed or otherwise interested in by virtue of this Act or otherwise howsoever and make and execute under its common seal or otherwise according to law all proper deeds and instruments and do all other acts, matters or things requisite or necessary to effectuate and accomplish all and singular the premises.

5. The said corporation shall have full power and authority to invest or lend all or any sums of money of or belonging to said academy or given or bequeathed to it in any land, stocks, debentures or securities of the Dominion of Canada or of the Province of Saskatchewan or in any debentures of any municipality or school district in

Saskatchewan or upon the security of any real or personal property or in the purchase of rental bearing real estate or to take, hold and dispose of any real or personal prop erty or interest therein for the purposes aforesaid.

6. The said corporation shall be capable of taking, Acquisition of holding and acquiring all such lands and tenements, property real and personal estate as may or shall have been bona fide mortgaged, hypothecated or pledged to the said corporation by way of security or conveyed to it in satisfaction of debts previously contracted or purchased at judicial sales upon levy for such indebtedness or otherwise purchased for the purpose of avoiding a loss to the academy in respect thereof or of the owner thereof:

Provided that any real estate acquired in satisfaction of any debts due to itself and not required for the actual use and occupation of the corporation or a branch thereof or for the purposes of the corporation the annual value of which together with the other lands of the corporation exceeds ten thousand dollars ($10,000) shall be sold by the corporation within seven years after such acquisition, or within any further period to which the term shall be extended by order of the Lieutenant Governor in Council, otherwise such real estate shall be forfeited to the Crown in the right of the province.

7. The said Luther Academy shall be under the Board of management and administration of a board of trustees to be called "the Trustees of Luther Academy" which shall consist of not less than five (5) and not more than eight (8) members.

8. Reverend Leo F. Tank, Reverend J. Fritz, Reverend First board E. G. Hertz, J. D. Miller and John Pfeifer shall be the first board of trustees under this Act and shall hold office until their successors are appointed as hereinafter provided..

9. The board shall have full power from time to time Board may to appoint and to remove the principal or other head, professors, tutors, masters and all officers, agents or servants of the academy and the board shall have full power from time to time to adopt or make and alter or vary a constitution and bylaws and regulations touching and concerning the time and place of holding board meetings, notices thereof, the procedure thereat and of the good ordering and government of the said academy, and such constitution and all such bylaws, when reduced to writing, and after the common seal of the academy has been affixed thereto, shall be binding upon all persons members thereof:
