CHAPTER 16

An Act to amend The Vital Statistics Act.

[Assented to February 9, 1922.]

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1. The Vital Statistics Act is amended in the manner Rev. Stat. c. 26 hereinafter set forth.

2. Paragraph 11 of section 2 is amended by inserting Section 2 after the word "marriages" the words "dissolutions of marriage."

3. Section 5 is amended by inserting after the word Section 5 "marriages" in the third line the words "dissolutions of marriage."

4. Section 7 is amended by inserting after the word Section 7 "marriage" when it occurs in subsections (1) and (2) the words "dissolution of marriage."

5. Subsection (3) of section 11 is amended by inserting Section 11 after the word "marriages" in the last line the words "dissolutions of marriage."

6. The following section is inserted after section 36: New section

36a

“36a.—(1) Every local registrar of the Court of Registration of King's Bench shall, when a decree absolute for dissolution of marriage has been entered by him, forward forthwith to the commissioner a return thereof in such form as may be prescribed by regulations made hereunder.

"(2) Every local registrar of the Court of King's Bench shall, on or before the first day of July, 1922, forward to the commissioner a return, in such form as may be prescribed by regulations made hereunder, of all such decrees entered in his office prior to the date when this section comes into force.

(3) The Lieutenant Governor in Council may make regulations for the registration of decrees absolute for dissolution of marriage."

7. Subsection (1) of section 39 is amended by adding thereto the following clause:

"(e) if in an hospital, by the medical superintendent, matron or other person in charge of the hospital."

8. Section 55 is amended by adding thereto the following subsection:

"(4) Any physician who attends a person at the time of his death shall forthwith send notice of the death in the prescribed form to the registrar of the division in which the death occurs."

9. Section 76 is repealed and the following substituted therefor:

"76. Prosecutions for penalties imposed by this Act shall be commenced within two years after the offence or default was committed, but no prosecution shall be commenced without the written authority of the commissioner."

10. This Act shall come into force on the first day of May, 1922.

CHAPTER 17

An Act to amend The Public Revenues Act.

[Assented to February 9, 1922.]

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1. The Public Revenues Act is amended in the manner Rev. Stat. hereinafter set forth

2. The following sections are inserted after section 12: New sections "12a. Notwithstanding anything in section 12 the Deposit in Provincial Treasurer may require a municipality to deposit moneys collected in respect of the public revenues tax in a chartered bank to the credit of the Provincial Treasurer in an account to be called "The Provincial Treasurer's Trust Account" and may prescribe the times when such deposits shall be made, and the Provincial Treasurer shall in such case allow the municipality the remuneration mentioned in section 12, such remuneration to be computed and paid quarterly.

"12b. On or before the tenth day of each month Monthly every municipality to which section 12a applies shall, if so required by the Provincial Treasurer, forward to that minister a statement showing all collections made during the preceding month."

3. Section 15 is repealed and the following substituted New section therefor:

"15. In the event of a municipality neglecting or Penalty for refusing to:

"(a) keep a separate and accurate account of all moneys received by it, as required by section 10;

"(b) forward moneys collected to the Provincial Treasurer as provided by section 12;

"(c) deposit moneys collected as provided by section 12a, when so required by the Provincial Treasurer; or

neglect or refusal

"(d) transmit to the Provincial Treasurer any report, statement or account on or before the day appointed for the transmission thereof;

such municipality shall be liable for every such neglect or refusal to a penalty of $1 for every day during which the default continues. Such penalty may be deducted from any remuneration that may be due to the municipality under section 12 or section 12a."

CHAPTER 18

An Act to amend The Succession Duty Act.

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

c. 30, amended

1. Clause (c) of section 7 of The Succession Duty Act, Rev. Stat. as enacted by chapter 22 of the statutes of 1920, is hereby repealed and the following substituted therefor:

"(c) on moneys received or receivable under a con-
tract of insurance effected on his life by a person
dying after this clause comes into force, if such
moneys are payable under the terms of the
contract to the husband, wife, child, grandchild,
or mother of the deceased and the total amount
of the moneys payable under any one contract
does not exceed $5,000, provided, however,
that if any one beneficiary receives more than
$5,000 by reason of the deceased having effected
two or more contracts of insurance on his life,
then the moneys received or receivable by the
beneficiary under such contracts shall not be
subject to any exemption under this clause."
